The parties may ask the court to settle the issues before the final hearing. The issues most commonly raised in applications include a party`s failure to comply with an interim order at the preliminary hearing or the structuring of matters relating to the conference and inquiry. In some counties, mediation is required before a controversial final hearing can be held. Ask the case worker if mediation is necessary for your case. If there has been domestic violence, you can file an application asking the judge to waive the mediation obligation. Call the Domestic Violence Legal Line at (800) 374-4673 for free advice if there has been domestic violence. If the other party does not agree on a hearing date, that is fine. You just have to make a reasonable effort.

Sometimes a legal aid office cannot accept a case because there are not enough legal aid lawyers available to provide assistance to all eligible people. However, in some communities, private lawyers volunteer their time to represent low-income clients free of charge and accept cases that the legal aid office cannot handle. Pre-trial forms give the judge detailed information about your case. Ask the case officer if pre-trial forms are required for your case. If so, complete your pre-trial forms and submit them as needed. Send a copy of your pre-trial forms to the other party. Bring the other copy to your final hearing. Most counties require you to make reasonable efforts to speak to the other party and set a final hearing date. If the other party has a lawyer, talk to the lawyer. 7. Parties must submit the same documents they would present at a preliminary hearing. The magistrate (or judge) can tell you on the day of the hearing what the final decision will say. Or you can receive it in the mail after it has been designed and signed. The order comes into force when the registrar enters it on the Court`s list, usually on the same day the judge or magistrate signs it. In addition, legal aid cannot accept so-called “fee-generating” cases. In a fee-generating case, a lawyer`s fees are paid out of the money awarded to the winning party. If you ask for legal help with your problem, you will be told whether it is a paid case or not. 5. Mediation. The court usually orders the parties to enter into mediation in order to reach a solution before proceeding with the legal proceedings.

If mediation fails, a preliminary hearing is scheduled. Watch the court`s video on mediation in the family department. 10th Conference on Case Management. If you and the other party don`t agree on all the issues in your case, you can ask a judge to decide those issues at a final controversial hearing. The judge listens to both parties and then makes a decision. You must follow the court`s rules of evidence and procedure at a controversial final hearing.

To help as many eligible people as possible, most legal aid agencies also use paralegals to help with their cases. Paralegals are not lawyers and cannot practise law, but they can represent clients at administrative hearings. For example, a paralegal may represent clients at hearings involving social assistance, supplementary security income or unemployment benefits. Paralegals can interview clients and let them know about their benefits. They also research and investigate cases and help negotiate with merchants, landlords or government officials. Paralegals are supervised by lawyers and help provide legal services to clients. The case officer will give you the date and time of the hearing. Ask for a hearing date of at least 60 days. (Keep in mind that the other party must receive a copy of your Notice of Final Hearing form at least 45 days before the date of the last hearing.) Call the clerk`s office.

Preliminary Hearing. The parties present their versions of the case through “offers of evidence”. This means that they simply show and tell the court what they intend to present at a later full hearing. Each game usually has 15 minutes. The parties must provide up-to-date financial affidavits and, if applicable, a proposed parenting plan, child support worksheet and uniform support orders. You must inform the opposing party of the final hearing at least 45 days in advance. You can`t just talk to the other party about the hearing. You must disclose it in a legally acceptable way and be able to prove to the judge that you did so.
