Michigan is home to three jurisdictions where the decriminalization of psychedelics exists. Psilocybin mushrooms are one of the most common types of psychedelics because of their relative safety and popularity. They are also easy to find on the black market. However, they are illegal in all 50 states. LSD (lysergic acid diethylamide) is currently neither legal nor decriminalized in any U.S. state. On January 1, 2022, Representative Michael Davis (R) filed HB 2429, originally introduced on February 18, 2021, as HB 1176. If passed, this legislation would expand Missouri`s Right to Try Act to prevent people with terminal or life-threatening illnesses from using substances such as MDMA, psilocybin mushrooms, LSD, MTD, MESCALINE, or ibogaine with a doctor`s recommendation, after exhausting all other approved treatment options if they are considered an “experimental drug.” The bill would also reduce penalties for possession of these drugs to low levels nationally. This is an overview of the legality of ayahuasca by country.
DMT, one of the active ingredients in ayahuasca, is classified as a Schedule I drug under the 1971 United Nations Convention on Psychotropic Substances, meaning international trade in DMT needs to be closely monitored. The use of DMT should be limited to scientific research and medical use. Natural materials containing DMT, including ayahuasca, are not regulated by the 1971 Psychotropic Convention. [1] The majority of countries in the world classify DMT as a planned drug; However, few countries seem to have laws that specifically address the possession or use of ayahuasca. “It will always come with this double-edged sword. If you relax the access rules, you have the potential for abuse or problematic use, which has happened in the past and in many ways has led to the illegality of psychedelics in the first place,” says Dr. Merrill. Gonzalez D, Cantillo J, Perez I, et al. Shipibo`s ceremonial use of ayahuasca to promote well-being: an observational study. Pharmacol front panel. 2021;12:623923.
doi:10.3389/fphar.2021.623923 As noted above, MDMA is only legal in the United States in FDA-approved clinical trials or in individual situations where its use has been deemed medically necessary. In 2020, Oregon voters approved measures to eliminate criminal penalties for all illegal drugs, including DMT and similar psychedelics. Oregon residents can be punished for possessing DMT or ayahuasca for non-religious purposes, but cannot be arrested or imprisoned. [2] Another bill introduced in the Assembly (A7109) and Senate (S1284) during the 2020-2021 legislature would eliminate criminal and civil penalties for possession of controlled substances and establish a Task Force on Drug Decriminalization to develop recommendations for legal reform “with the stated goal of treating substance use disorders as a disease rather than criminal behaviour.” People around the world are discovering the mental health benefits of psychedelics, but where are psychedelics legal? Legality encompasses a wide range of possibilities: in some places, ayahuasca is specifically legal (e.g., Peru), while in others there is simply no legislation that explicitly prohibits it (e.g., Argentina). On February 17, 2021, Senator Scott Wiener introduced Senate Bill 519, which would remove criminal penalties for possession of psilocybin, psilocyne, MDMA, LSD, DMT, ibogaine and mescaline (other than peyote) for personal use and social sharing. Personal use and possession of entheogenic plants has become the lowest priority for law enforcement in the city of Ann Arbor, Detroit, Hazel Park and Washtenaw County, where it is based. Laws have also been introduced to decriminalize Schedule 1 and Schedule 2 substances and legalize “natural plants and fungi” nationwide. Resolutions passed unanimously in the cities of Oakland and Santa Cruz have made personal use and possession of certain psychedelics the lowest law enforcement priority. SB-519, which would have legalized personal use and possession at the state level, was approved by the entire Senate after several amendments, but did not find enough support to pass the House Budget Committee and was suspended until the January 2022 session. On June 18, 2021, HB1802 came into force. It shall apply from 1 September 2021 until its expiry on 1 September 2023. The bill provides for a study conducted by the state Department of Health Services to evaluate the therapeutic effectiveness of alternative therapies such as MDMA, psilocybin and ketamine to treat specific mental illnesses and conditions such as depression, anxiety, PTSD, bipolar disorder, chronic pain and migraines.
The ministry will evaluate and compare the effectiveness of these new treatments with current treatments and prepare and submit a report by December 1, 2022. $1.4 million was allocated to directly fund a clinical trial of psilocybin for the treatment of PTSD in veterans. Psilocybin mushrooms are still illegal at the state level. However, the cities of Oakland and Santa Cruz have decriminalized psilocybin mushrooms, making their possession and use a low priority for law enforcement. On March 12, 2021, the concurrent resolution of the House No. 174, which calls for the creation of a “Medical Psilocybin and Psilocin Task Force” at the Ministry of Health and calls on members to study current psilocybin laws, existing research related to the “safety and efficacy” of psychedelics for mental health treatment, and to propose guidelines for medical professionals to “prescribe and provide psilocybin” to patients. The task force “is encouraged to develop a long-term strategic plan to ensure the availability of medical psilocybin and psilocin or psilocybin products that are safe, accessible and affordable for adults twenty-one years of age and older.” Other states have begun to decriminalize certain psychedelics, mainly in certain cities. That is, although drugs are still technically illegal, they have the lowest priority for law enforcement and criminal charges do not apply if a person has a small amount of the substance.
While Oregon is currently the only U.S. state where psilocybin has become legal for therapeutic purposes, more than a dozen other cities and counties have effectively decriminalized psilocybin and other entheogens. A measure that would legalize psychedelics nationwide will be presented to Colorado voters in November 2022. On November 2, 2021, Detroit voters approved Proposition E to enact a municipal ordinance that “decriminalizes personal adult possession and therapeutic use of entheogenic plants and makes the personal possession and therapeutic use of entheogenic plants by adults the lowest priority for city law enforcement.” Entheogenic plants include “the full spectrum of plants, fungi and natural materials and/or their extracted compounds, limited to those containing the following types of compounds: indolamines, tryptamines and phenethylamines”. If you want to try a psychedelic drug, you should first do your research and find out which conditions are the most forgiving.
