Although not a specific offence per se, some cases of upskirting could be prosecuted under existing legislation, such as the common law offence of “indecency” or the existing voyeurism offences in the Sexual Offences Act 2003. However, there have long been concerns that the law is not fit for purpose, as the act must be prosecuted in a “public place” and in the presence of at least two other people as a violation of public decency, with prosecutions under the Sexual Offences Act for “voyeurism” requiring that the victim be “observed in a private act in one place, which, in the circumstances, could reasonably guarantee privacy.” Several sports teams in the United States have or have had names considered offensive to Native Americans. For years, many teams tried to get around the problem by saying that their names were actually tributes to Native American culture and that they would donate to Native American causes. They tried to get around the problem: their names were created in a less enlightened time, a time when society was less sensitive to how some of those names sound.
