Rules for Running a Prize Draw

They do this with the best of intentions to be transparent and show that all those who answered the contest question correctly (and those who chose the free entry route) will be included in the draw. Participation in a sweepstakes is not gambling unless it meets the definition of “gambling”, “betting” or “participation in a lottery”. If you can prevent your competition from falling under these legal definitions, you can exploit it without a license. Before you run your free draw or contest, find out about the rules so that your free draw or prize contest complies with the law. However, sweepstakes and contests may be subject to regulatory review if not conducted properly. If they are not regulated by appropriate conditions and rules and are not properly structured, the company that starts the systems can be put at risk. First of all, you need to be clear about what the prize is and how you can participate. North Carolina: Sweepstakes, Games, Bingo and Lotteries GS § 289-309.2, Presentation of GS Prize Winning § 75-32, Presentation of eligibility to win a GS Prize § 75-33 The CAP Code contains rules established by the Advertising Standards Authority (ASA) that govern how you run and promote your contests. Therefore, in my opinion, it is better to publish an anonymous list. For example, give people an entry number or simply display a name and initials so people can check if they are in the draw, but cannot be easily identified.

You must ensure that you award the prize as you have described it, or a reasonable alternative that is approximately equivalent. You must normally provide the prize within 30 days, unless you have specified a different period in your terms and conditions, and make all reasonable efforts to contact the winner (ringing the bell once is not enough). But before that, we need to be clear about the type of competitions we organize. This is important because the words “raffle”, “lottery”, “sweepstakes” and “raffle” are often used interchangeably, but they actually describe different activities and different laws apply to each. What we`re going to talk about today are the rules for holding a draw. These are usually paid for participation in competitions that take place for the organizer`s winnings. The winner will be selected at random from all participants who correctly answer the competition question (or who participate via the free registration channel – more on this below). Now that we are clear about the different types of contests, let`s look at the laws that a contest organizer must comply with. Everyone loves a freebie, so it`s no surprise that raffles and giveaways are becoming increasingly popular on social media platforms. Running a raffle can improve customer loyalty to your brand, raise your company`s profile, and help you build customer loyalty. Using social media influencers to promote your raffle can also be a great way to reach new audiences and raise awareness.

However, if you run a sweepstakes, you must ensure that you comply with consumer laws and promotional codes in order to treat entrants fairly and equitably. Certain codes of conduct may also apply when promoting a sweepstakes or contest. There are two common ways to avoid this: (1) integrate a real and clearly visible free entry channel (e.g., postal entry) or (2) integrate real skills to prevent a significant portion of people from winning or participating. The rules of free entry and skills are complex and you should seek legal advice on your proposal before proceeding. Participation in contests is free and serves to promote sales. For example, you can encourage your customers to buy a specific product by asking them to enter a free sweepstakes to win a prize. There are a variety of regulatory aspects to consider when holding a sweepstakes or contest – in particular, whether it would fall under gambling legislation. The general promotion rules in the CAP Code apply to sweepstakes and contests, and the terms and conditions of sweepstakes or contests may need to reflect these rules, as the CAP Code requires prize promoters to include additional material terms in their marketing communications. A prize contest is when the outcome is determined by the skill, judgment or knowledge of the entrants.

Prize competitions, which require entrants to exercise a certain level of skill, judgment and knowledge, are not considered sweepstakes, but potential problems can arise when a contest is structured in such a way that little or no skill is actually required. The organizer of a raffle or lottery needs a license to organize it. So here it can be confusing if you`re actually running a contest but call it a “raffle” or a “lottery.” A lottery requires people to pay to participate, so if there is a prominent and authentic free entry route as an alternative to payment, the contest is legal. The rules for free entry are complex, so you should seek legal advice before proceeding. Sweepstakes and lotteries are held to raise money for charities and good causes. People pay to enter and the winner is chosen at random. The difference between a sweepstakes/sweepstakes and a contest is that you don`t have to ask questions or offer a free entry path. You will almost always be required to collect and use entrants` personal information when running a promotional contest or sweepstakes.

For example, you may need to collect the names and contact details of entrants so that you can notify them when they have won and publish the names of winners. Prize promotions (also known as free sweepstakes and sweepstakes) and contests can be invaluable to your business, especially a new business or start-up. There are many reasons why you should consider a prize action or contest. Promotions and prize contests may: In a skills contest, the winner must be chosen primarily based on their skills rather than their chance to be legal. An illegal lottery consists of three elements: 1) prizes; 2) coincidence; and (3) consideration. To legalize your skill advancement, the element of chance must be eliminated. The Gambling Commission prevents illegal gambling and can act if free draws or contests are held as illegal lotteries. However, if you do not follow the strict provisions of gambling law, you will accidentally run an illegal lottery. Privacy compliance is something all companies need to pay attention to, but again, contests can have specific issues. In this article, I will explain how to comply with the three most important laws that apply to contests. These terms include (but are not limited to) restrictions on the number of entries, any cash prize alternatives, how and when winners will be notified and prizes will be received, how entries will be judged and all information regarding copyright transfer, publicity and return of entries.

You may only collect and use the information strictly necessary to carry out your promotion and store it securely and for as long as you need it. Before collecting personal information, you must explain exactly why you are collecting it and what you intend to do with it (usually by giving participants access to a privacy policy that includes that information). For full guidance on your data protection obligations when processing customer data, see Collection of personal data. In traditional prize draws, you must ensure that winners are selected randomly, either using a demonstrably random computer process or by using an independent observer to select or supervise the draw (for example, from a hat). It is very important that your sweepstakes provides all important terms in advance in marketing materials for customers before they decide to participate. You must also ensure that the terms and conditions are available to participants for the duration of the promotion. Rule 8 of the CAP Code defines the rules applicable to the organizers of competitions/contests.

Below, we`ve laid out some of the most important rules, but you need to make sure you know and comply with all the specific provisions of the CAP Code before running a promotion. Non-material conditions must also be provided before or at the time of a customer`s participation in the competition, but do not necessarily have to be as important as the essential conditions. For example, they could be included in an accompanying brochure or on another web page related to the ad. Contest Organizers must be able to demonstrate that the required skill, knowledge or judgment: Another activity that may cause problems for Organizers is when they try to force winners to participate in the promotion.
