Legal Meaning of Intimidation

(a) A person is guilty of criminal intimidation if he coerces or knowingly induces another person to do an act that he is not legally entitled to perform or fails to perform an act that he has legal privilege to perform by threatening: In short, bullying is behaviour that makes another person fear for his or her own safety; or that of a family member or compensation for damage to their property. Several states have a crime called “ethnic bullying.” For example, Michigan state law states:[8] The period during which the alleged bullying allegedly took place is significant. For example, bullying a person over a longer period of time, compared to saying a few words and then walking away. Bullying can be a civil offense in addition to a criminal offense in some U.S. states. For example, in Oregon, violating the state`s criminal law on intimidation results in a civil violation. [11] The plaintiff in the civil action for intimidation may then seek relief, including an injunction or special and general damages. [11] For legal purposes, bullying is defined in section 7(1) of the Crimes (Domestic and Personal Violence) Act 2007 (NSW) as follows: Threatening behaviour can be conceived as an inappropriate consequence of the normal competitive race to inter-relational dominance in animals in general. Alternatively, bullying can result from the type of society in which individuals are socialized, as people are usually reluctant to engage in confrontation or threaten violence. [4] However, not all unpleasant interactions are bullying.

The context of the interaction is extremely important, as is the context between the parties. This includes the offender`s age, criminal record, attitude to the crime and, most importantly, any rehabilitation he or she has undertaken.

Medieval Latin intimidatus, past participle of intimidare, from Latin in- + timidus timid A court can impose a prison sentence for very serious cases of intimidation. However, prison sentences do not necessarily have to be served inside a prison. The court may allow a person to serve their prison sentence in the community under an intensive correction order (ICO). Intent is also defined differently in cases of bullying. Intent is fulfilled when the prosecutor can prove that the person knew that his or her behavior could cause fear in the other person. If a plea of not guilty is filed, the case is transferred to a trial or hearing where the court determines the innocence or guilt of the person. Bullying can manifest itself in the form of physical contact, a beaming face, emotional manipulation, verbal abuse, a person feeling inferior to you, intentional embarrassment, and/or actual physical aggression. “Conduct may include, but is not limited to, derogatory epithets, comments or insults and suggestive innuendo, bodily harm, obstruction or blocking of movement, improper touching or physical interference with normal work or movement, and visual insults such as derogatory posters or caricatures. Namely, was the person`s behaviour intimidating? One of the most important factors in sentencing is the objective seriousness of the crime compared to other intimidation offences. Participating in voluntary rehabilitation programs such as anger management sessions or seeking professional help from a psychologist is a great way for a person to show the court that they are ready to change and improve. In determining whether a person`s behaviour constitutes bullying, a court may also consider any pattern of violence in the person`s behaviour. However, the maximum penalty is reserved for the most serious cases of intimidation. In most cases, the maximum penalty is only indicative. The maximum penalty is not the starting point for a penalty. Good character can be demonstrated through a person`s involvement in the community. It can also be justified by character references.

Paragraph 9(1)(b) Conditional release order (CRO) without conviction (formerly known as a section 10 bond) means that intentionally saying or doing something that would make an ordinary person of sensitivity fear an assault. If the court determines that a criminal conviction is necessary, the most common penalties a court will impose in a bullying case are: In California, criminal threats are a wobble and can be charged as either a misdemeanor or a felony under California Penal Code 422. In addition to general conditions and supervision, the court may also include community service as part of good conduct. The court must consider how the bullying occurred. In general, the more direct the intimidation, the more objectively serious the crime. For example, if it was done in person, by phone, email or by third parties. [6] In assessing this issue, however, an important point to note is that while intoxication is not a legal defence in New South Wales, the courts have concluded that intoxication may be taken into account in determining whether the defendants knew their behaviour was “likely” to intimidate. The second element that the prosecution must prove concerns the intent of the person. “Bullying” is the name of a crime in several U.S. states.

Definitions of the crime of intimidation vary from state to state. A court may also sentence a person to parole for an offence of intimidation. A conditional release order is a duty of good behaviour that can be imposed with or without the registration of a conviction.
