City dwellers with larger dogs may have a harder time finding a rental property that allows their pet. However, if you are willing to prove good training, provide references, and introduce your dog, you can always try to attract a hesitant owner. Just be prepared to work harder for any apartment search. What most people don`t know is that squirrels, pigs, and iguanas, among many others, are considered a type of exotic animal and are allowed to be illegally kept as pets in New York City. Now that you know the rules, talk to your landlord about the security deposit and pet rental policy. It`s a small price to pay for your furry friend`s company. But according to brokers Brick Underground spoke to, some landlords are still looking for extra money to cover their costs for damage and stains caused by four-legged tenants. So if you sign a new lease and have a pet, you can now be asked for a one-time pet fee or a monthly “pet rental” (in addition to your own rental). Of course, a security deposit that will be refunded to you if there is no damage is more desirable than a tax or pet rental, so changing rental laws can hurt some pet owners. Property licensees, landlords, property management companies and lawyers must ensure that a tenant is informed in advance that they have the right to inspect the premises. The law states that a landlord is prohibited from charging and collecting application fees or similar fees in addition to rent under a lease.
However, the law does not expressly prohibit a tenant from paying a rental fee or commission to the real estate agent in connection with a rental transaction. If there is a listing agreement, commission agreement, or other agreement that requires a tenant to pay a rental fee or commission, this appears to be allowed. It is recommended that the tenant pay the rental fee directly to the real estate agent and not as a refund to the landlord. The 2019 law is causing widespread confusion among real estate professionals. Property owners and managers are not happy with the significant changes introduced by the legislation for rent-regulated rental housing and the market, to say the least. On July 15, several homeowners filed a lawsuit [see bit.ly/2KsEQZK] claiming that they “. were deprived of their property without due process, in violation of the due process clause of the Fourteenth Amendment to the Constitution” and were further “.. were deprived of their right to own, use and dispose of their property without fair compensation, contrary to the extraction clause of the Constitution. The 2019 law is likely to have a negative impact on property values and the entire rental and sale market. Recent rent reform measures in the Big Apple prohibit landlords from charging more than one month`s rent as a deposit. This prohibits the pet deposit, an additional deposit for a dog or cat that can be used to cover damage to pets at the end of the lease.
Another option is to pay some rent upfront. Owners don`t like uncertainty any more than anyone else. When they have rent money upfront, they tend to become more comfortable with tenant requests. Provide the potential building owner with a photo showing the dog`s calm and socialized behavior. The 2019 law requires the landlord to return the deposit to the tenant within 14 days of the termination of a lease or the eviction of an apartment by the tenant, whichever is later. However, if a landlord wishes to withhold a portion of the deposit, they are required to provide the tenant with a detailed written statement of repair costs and expenses based on the tenant`s occupancy. The declaration must be provided to the tenant before the expiry of the 14-day period. This process should be clearly stated in each lease so that the parties are aware of these requirements. New subsection 1-a of GED Articles 7-108 states: One thing that can easily be said is that caring for a dog in New York is completely different and much more difficult, physically, mentally and financially than anywhere else, so patience is key.
