Is Euthanasia Legal in Uae

Unfortunately, euthanasia is still considered taboo in Arab countries and is hampered by many legal consequences. Article 157 of the Kuwaiti Penal Code provides that a person is guilty of murder even if the victim has suffered an illness or injury that would result in death and the perpetrator has shortened his life. Article 538 of the Syrian Penal Code punishes anyone who euthanizes with three to ten years` imprisonment. As far as Egyptian law is concerned, no text on euthanasia is proposed. Dubai`s health authorities have rejected euthanasia requests from a group of local doctors, better known as the mercy killing of dying patients, saying ending a human life is not allowed in the United Arab Emirates, an emirate newspaper reported on Wednesday. Although the UAE`s medical liability law does not contain a specific euthanasia clause, a religious fatwa does not allow medical professionals to fulfill the patient`s or family`s death wish. The Church categorically rejects both euthanasia and assisted suicide. Nesreen Al Alfi of Fatima College for Health Care Sciences in Abu Dhabi and a member of the working group said it was difficult to overcome cultural beliefs and a legal system without approved policies to “not resuscitate” or “allow natural death”. Requests for euthanasia fall directly into two main categories: First, patients who do not have family or spouse to help them usually demand their right to a dignified death, arguing that being asked to keep the suffering in silence is incredibly brutal. Second, some families seek euthanasia to relieve their psychological distress, as the images associated with patients going through a prolonged period of death while suffering are far more distressing than witnessing a predestined death. Euthanasia is legal in Belgium for someone who suffers unbearably and does not want to heal. If this person is not terminally ill, a one-month waiting period is required.

There is no age rule for those who request euthanasia, but for a child to be considered, he must have an incurable disease. However, there is some light at the end of the tunnel; Article 18 of the Kuwaiti Penal Code allows the court to refrain from passing judgment against euthanizing immortalists, taking into account their morality and the circumstances in which they committed the crime. Article 96 of the UAE Penal Code states that the ground of clemency for murder is a legal excuse that reduces the sentence. To be eligible for legal approval, a person must have an adult with decision-making capacity, be a resident of Victoria and suffer from an unbearable condition due to illness with a life expectancy of less than six months or 12 months. Colombia already allows euthanasia, in which a doctor administers a life-ending drug. “The UAE and Libya have criminalized and punished euthanasia,” he said. According to official figures, fewer than 200 people have opted for euthanasia in Colombia since 1997. Spanish lawmakers on Thursday legalized euthanasia and assisted suicide for people with serious and incurable or debilitating illnesses who want to end their lives, making Spain the fourth European Union country to take the step. In many countries, euthanasia is illegal and can lead to a murder conviction. However, there are some countries where it is legal under strict conditions. Switzerland has perhaps the least regulated euthanasia laws, as a diagnosis is not required by the doctor administering the lethal drug and there is no age limit.

Nevertheless, euthanasia is not permitted if the person advocating physician-assisted suicide can obtain something like a legacy of the person`s death. While euthanasia and suicide are not the same thing, it is worth noting people`s views on suicide in general. Suicide is a great sin in Islam and Christianity. In Islam, the Qur`an forbids people to commit suicide; “And don`t kill each other (or each other). Truly, Allah is always merciful to you (Al-Baqara, 2:29). Moreover, according to Sahih, Thabit told Ibn Al-Dahak of Bukhari that the Prophet Muhammad said: “Whoever kills himself with anything in this world will be tortured with it on the Day of Judgment. According to the Universal Declaration of Human Rights, there is a general consensus that all patients have a fundamental right to confidentiality and the privilege to accept or refuse treatment. The law does not consider it murder for a patient with heart disease or cancer to refuse treatment when the treatment will preserve his life, so why not also recognize euthanasia, since it leads to the same goal? Unlike murder, euthanasia does not surprise patients; Physicians always obtain written consent from their patients when they are still conscious and mentally competent. If the patient`s doctor or family does not comply with all material obligations, they will be punished by law. For example, in 2019, a Dutch doctor was tried for lack of communication with the patient and failure to confirm the patient`s wish to die. If a couple has difficulty conceiving naturally, the law gives them the option to try assisted reproduction or biological procedures to treat infertility, provided that only legally related couples can undergo artificial insemination or in vitro fertilization (IVF) after signing and submitting a declaration accepting medically assisted reproduction before starting treatment. Logically, euthanasia cannot be equated with murder, since euthanasia is not a violent crime.

Murder is, by definition, death by violence at a time chosen by the murderer and not by the will of God. In contrast, patients suffering from worsening neurological disease or brain death are already biologically dead, so hastening their prolonged death is not murder! Laconically, euthanasia may be a controversial topic that not everyone agrees on, but revising our paradigm and the ideas we have is something we all need to do. In Lebanon, there is no law that authorizes euthanasia, and therefore execution is considered a crime punishable by the perpetrator, his partner, the instigator and anyone who intervenes. Article 552 of the Lebanese Penal Code states: “Anyone who intentionally kills a person out of compassion shall be punished by ten years` imprisonment, depending on the urgency of the request.” Colombia decriminalized euthanasia in 1997, and in July 2021, a high court extended this “right to a dignified death” to those who do not suffer from an incurable disease. Euthanasia is highly controversial and illegal in many countries. Some critics argue that God gives all life and that only God has the right to take it. Others worry that if euthanasia becomes legal, doctors could begin euthanizing patients against their will. Those who think this way sometimes refer to Nazi Germany, which propagated its genocide of Jews, Gypsies, the disabled and political dissidents as euthanasia. Luxembourg, Canada, Australia and Colombia allow euthanasia for adults who suffer unbearably and will die from their disease. In Australia, a doctor cannot promise euthanasia; The patient must ask explicitly – three times. The decision on how much to leave in place is mostly a private matter.

Human rights and political correctness dictate that a state has no right to interfere except on social matters. Therefore, governments should treat people as free agents who have the prerogative of a legal option at the end of life, because such a choice does not harm others. Let`s take a look at the countries where this process is legal: There are states in the United States where euthanasia is legal for terminally ill patients.
